Open For Public Comment:

The Administrative Office of the Courts and Probation invites interested persons to comment on the proposed edits to the Service Definitions for Adult and Juvenile IOP and OP counseling services.

Anyone desiring to submit a public comment for consideration should do so via email to mark.bless@nejudicial.gov.  Comments will be accepted through March 4, 2026.  Please see below for the rationale behind the requested changes:

  • IOP – services are to be in-person (teleservices can only be permitted via formal approval by AOCP).  Medicaid does not fund teleservices for IOP level of care.  It is our intention to align with Medicaid, while evaluating unique individualized circumstances.
  • IOP (Juvenile) – According to the American Society of Addiction Medicine (ASAM), youth IOP services specifies 6 or more hours of skilled treatment.  This change is to align with ASAM, as well as Medicaid/Department of Health and Human Services (DHHS) service definitions.
  • OP – Per Medicaid requirements, treatment plans are to be clinically reviewed every 90 days or more often as clinically indicated.  This change is to align with Medicaid service expectations.
