Proceedings Below: The district court entered summary judgment in Appellee’s favor on a breach of contract claim, and the Court of Appeals determined that there were genuine issues of material fact, reversed, and remanded the case back to the district court for further proceedings. See WRK, L.L.C. v. Wiegert, A-24-0143 (July 1, 2025) Appellee petitioned for further review, which the Supreme Court granted and transferred this case to it docket.
Issues: On petition for further review, Appellee assigns the following errors: 1) The Nebraska Court of Appeals erred in reversing the trial court’s order granting Appellant’s motion for summary judgment; 2) The Nebraska Court of Appeals erred in finding that a material issue of fact exists regarding Appellant’s motion for summary judgment; and 3) The Nebraska Court of Appeals erred in finding that Josh Berger and Jude Beller’s deposition testimony creates a material issue of fact.
