Proceedings below: Appellant brought suit to enjoin the Nebraska Secretary of State from certifying or printing on the November 3, 2026, ballot the “Fairness for Girls” initiative petition. The district court dismissed the suit. On its own motion, the Nebraska Supreme Court ordered this case to be transferred from the docket of the Nebraska Court of Appeals to its docket.
Issues: Appellant assigns the following errors: 1) The district court erred when it found that the object statement for the “Fairness for Girls” initiative measure complies with the requirements of Neb. Rev. Stat. §§ 32-1401 and 32-1405; 2) The district court erred when it found that ballot sponsors need only substantially comply with the object-statement requirements of Neb. Rev. Stat. §§ 32-1401 and 32-1405; and 3) The district court erred by determining that the Fairness for Girls initiative measure is legally sufficient and by failing to enjoin the Secretary from placing the Initiative on the ballot.
