Proceedings below: The district court denied Appellant’s request for a self-defense jury instruction, and a jury found him guilty of assault by a confined person. Appellant was sentenced to not less than three (3) years in prison and not more than three (3) years in prison. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant assigns the following errors: 1) The district court erred by refusing to give Appellant’s proposed self-defense instruction to the jury; 2) There was insufficient evidence to sustain Appellant’s conviction under Neb. Rev. Stat. § 28-932; and 3) The sentences imposed by the district court were excessive and constituted an abuse of discretion.
