Appeal from the District Court for Lancaster County, Judge Jodi L. Nelson

Attorneys: Abby Osborn (Schiffermiller Law Office, PC, LLO for Appellant) and Austin N.  Relph (Asst. Attorney General for Appellee)

Criminal:  Possession of a controlled substance with intent to deliver and credit for time served

Proceedings below: Appellant pled no contest to possession of a controlled substance with intent to deliver, and the district court sentenced him to twelve (12) to fifteen (15) years in prison.  He was not given any credit for time served. On its own motion, the Supreme Court ordered that this case be transferred from the docket of the Court of Appeals to its docket.

Issues: Appellant assigns the following error: 1) The trial court erred in determining that Appellant was not entitled to credit for the 638 days served in Lancaster County jail because it was not credited to any other sentence.
