Proceedings below: A jury convicted Appellant of three counts of burglary, one count of attempted burglary, and one count of theft by unlawful taking (over $5,000). He was given an aggregate sentence of seven (7) years to twenty (20) years’ imprisonment. On its own motion, the Nebraska Supreme Court ordered that this case be transferred from the docket of the Nebraska Court of Appeals to its docket.
Issues: Appellant assigns the following errors: 1) The district court erred in admitting evidence into the trial over the objection of the Appellant; 2) The district court abused its discretion by failing to give a lesser included offense instruction to the jury; and 3) The district court abused its discretion by imposing upon the Appellant an excessive sentence.
