Criminal: Life imprisonment for first-degree murder
Proceedings below: After a jury found him guilty, Appellant was sentenced to forty (40) years to life imprisonment for first-degree murder and was given an aggregate sentence of one-hundred-thirty (130) years’ to two-hundred-ten (210) years’ imprisonment for the following convictions: robbery; first-degree assault, two (2) counts of discharging a firearm at an inhabited house, occupied building, or occupied motor vehicle; and theft by receiving stolen property valued at more than $5,000. Life imprisonment cases are direct appeals to the Nebraska Supreme Court.
Issues: Appellant assigns the following errors: 1) The finder of fact erred in finding the evidence sufficient to support a verdict of guilty beyond a reasonable doubt with regard to robbery and use of a firearm to commit the robbery; 2) The district court erred in not adopting Appellant’s proposed jury instruction; and 3) The district court abused its discretion in sentencing Appellant to a total term of 320 years to life.
