Criminal: Burglary and a motion to quash
Proceedings below: After the district court overruled Appellant’s motion to quash, he pled guilty burglary. He was he sentenced him to not more than fifty-one (51) months in prison and not less than one-hundred-eight (108) months in prison with credit for time served. On its own motion, the Nebraska Supreme Court ordered this case to be transferred from the docket of the Nebraska Court of Appeals to its docket.
Issues: Appellant assigns the following errors: 1) The district court erred in denying Appellant’s motion to quash; and 2) The district court erred in convicting and sentencing Appellant for burglary.
