Proceedings below: Appellant pled guilty to theft by shoplifting (third or subsequent offense), and he was sentenced to two (2) years’ imprisonment without post-release supervision. He was not given credit for time served. On its own motion, the Supreme Court ordered that this case be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant assigns the following errors: 1) The trial court erred in sentencing Appellant to incarceration, rather than probation, and failed to properly advise Appellant of his right to appeal and how much time he is required to serve assuming no loss of good time; 2) The trial court erred in sentencing Appellant to a term of 2-2 years and 0 months of Post Release Supervision; and 3) The trial court erred in not granting a continuance of the sentencing so that Appellant could engage in residential treatment.
