Criminal: Third-degree sexual assault of a child  

Proceedings Below: Appellant was convicted of third-degree sexual assault on a child, and the district court sentenced him to (3) years’ imprisonment and eighteen (18) months of post-release supervision.  In a memorandum opinion, the Nebraska Court of Appeals found that the district court erred in admitting evidence that Appellant assaulted his son, and it remanded the case for a new trial.  See State v. Cartwright, A-24-0295 (April 8, 2025).  The State petitioned for further review, which the Nebraska Supreme Court granted and ordered that this case be transferred to its docket.   

Issues: In its petition for further review, the State assigns the following error:  1) The Court of Appeals erred in holding that the district court abused its discretion in admitting evidence of Cartwright’s assault of his son, A.R
