Criminal: Obstructing a public road
Proceedings below: Appellant pled no contest to one count of obstructing a public road, which is a Class V misdemeanor. He was fined $100.00, ordered to pay court costs of $62.00, and ordered to pay restitution to Gage County in the amount of $15,000. On appeal, the district court affirmed the fine and court costs but vacated the restitution order and remanded the issue to the county court for further proceedings. On its own motion, the Nebraska Supreme Court ordered this case to be transferred from the docket of the Nebraska Court of Appeals to its docket.
Issues: Appellant assigns the following error: The district court erred in finding that the county court did not abuse its discretion in ordering Appellant to pay restitution.
