Proceedings Below: Appellant was convicted and sentenced to life imprisonment for first-degree murder, to thirty (30) to fifty (50) years in prison for use of a weapon to commit a felony, and to three (3) to four (4) years in prison for possession of a deadly weapon. His convictions and sentences were affirmed on direct appeal in State v. Anthony, 316 Neb. 308, 4 N.W.3d 393 (2024). Appellant filed a motion for post-conviction relief, which the district court denied. Life imprisonment cases are direct appeals to the Nebraska Supreme Court.
Issues: Appellant makes the following argument on appeal: 1) Appellant’s United States Constitutional rights under the Sixth, Eighth, and Fourteenth Amendments were violated, including the Nebraska Constitution, Article I, Sections 1, 3, 6, and 11, because of ineffective assistance of counsel when the trial counsel failed to provide “all” exculpatory evidence and witness’ for Appellant’s defense during pre-trial, trial, and sentence, as well as counsel’s failure to object to the false testimony of law enforcement officers in regards to crime laboratory DNA and blood test results in the presence of the jury; thus, due process and Brady violations.
