S-25-0697 Jami L. Roth n/k/a Jami L. Sunde (Appellee) v. Kristopher P. Marcoe (Appellant)
Appeal from the District Court for Seward County, Judge James C. Stecker
Attorneys: Angelica W. McClure (Kotik & McClure Law for Appellant) and Terrance A. Poppe and Megan E. McDowell (Morrow, Poppe, Watermeier & Lonowski P.C. for Appellee)
Civil: Termination of Parental Rights
Proceedings below: Appellant and Appellee share two children. Appellee filed to terminate Appellant’s parental rights, which the district court granted after a hearing. The district court also set aside and vacated an order for Appellee to show cause why she should not be held in contempt of the court order for violating Appellant’s parenting time. On its own motion, the Nebraska Supreme Court ordered this case to be transferred from the docket of the Nebraska Court of Appeals to its docket.
Issues: Appellant assigns the following errors: 1) The trial court erred by not transferring this case to the juvenile court for further proceedings; 2) The trial court erred in granting Appellee’s complaint to terminate Appellant’s parental rights; 3) The trial court erred in not modifying the current custody as a least restrictive alternative to termination; and 4) The trial court erred in vacating the order to show cause without finding Appellee had violated the court order.
