S-25-0297 In re Estate of Franklin Schneider, Deceased. Chris Schneider (Appellant) v. Kyle Schneider, in his capacity as personal representative (Appellee)
Appeal from the County Court for Douglas County, Judge Sheryl L. Lohaus
Attorneys: Benjamin C. Deaver, William N. Beerman, and Sydney M. Grad (Pansing Hogan Ernst & Buser LLP for Appellant) and Anthony T. Baudler and Anne-Marie O’Brien (Smith, Pauley LLP for Appellee)
Probate: Interpretation of will
Proceedings below: The county court denied Appellant’s petition that sought a supervised administration of Decedent’s will and sought a determination of entitlement to estate assets related to the business of Decedent. On its own motion, the Nebraska Supreme Court ordered this case to be transferred from the docket of the Nebraska Court of Appeals to its docket.
Issues: Appellant assigns the following errors: 1) The county court erred in finding that the will is unambiguous; 2) The county court erred in finding that it was prohibited from considering the affidavit of Chris Schneider; 3) The county court erred in failing to find that the shop was either a business, part of a business, or an interest in a business within the meaning of Article Tenth of Will; 4) The county court erred in endorsing the Amended Inventory and finding that all “business” assets had already been distributed to the Appellant; and 5) The county court erred in denying Appellant’s request for supervised administration.
