S-25-0430 Libby A. Munsell (Appellee) v. Jacob L. Munsell (Appellant)
Appeal from the District Court for Buffalo County, Judge John H. Marsh
Attorneys: Jennifer N. Rowling (Tye & Rowling, PC, LLO for Appellant) and Bradley Holbrook and Samantha J. Merrill (Jacobsen, Orr, Lindstrom & Holbrook, P.C., L.L.O. for Appellee)
Civil: Dissolution of marriage
Proceedings below: In a decree of dissolution of marriage, the district court awarded Appellee sole legal custody of the party’s children and denied Appellant his request to enroll the children in church camp. On its own motion, the Nebraska Supreme Court ordered this case to be transferred from the docket of the Nebraska Court of Appeals to its docket.
Issues: Appellant assigns the following errors: 1) The district court abused its discretion in granting Appellee sole legal custody of the children; 2) The district court abused its discretion in denying Appellant his constitutionally protected right to enroll the children in a church camp during his custody periods; and 3) Alternatively, the district court abused its discretion in denying Appellant the ability to enroll the children in a church camp during his custody periods, as the restriction is not in the children's best interests.
