Case Summary

A-26-0147, In re Interest of Susana R. et al., State of Nebraska v. Maria L. (Appellant)

Separate Juvenile Court for Douglas County, Judge Chad M. Brown

Attorney for Appellant: Deana D. Klein and Kamille C. Sweenie (Dornan, Howard, Breitkreutz, Dahlquist & Klein, PC LLO)

Attorney for Appellee: Daniel Gubler (Deputy Douglas County Attorney) and Averie Hannah

(Senior Certified Law Student).

Juvenile: Parental Termination under Neb. Rev. Stat. § 43-292(2), (6), and (7)

Action Taken by Trial Court: The State filed a petition in the juvenile court alleging Maria’s children were juveniles within the meaning of Neb. Rev. Stat. § 43-247(3)(a). It also filed a motion for ex parte emergency temporary custody of the children. The juvenile court granted the State’s motion for ex parte emergency temporary custody and ordered the Department to take temporary custody of Maria’s children. Throughout the pendency of the case, the juvenile court ordered Maria to complete several goals and provide proof of her accomplishments with reunification as the permanency objective. The juvenile court further directed DHHS to provide interpreters for all services for the family given Maria spoke Q’anjobal. The State later filed a motion to terminate Maria’s parental rights under Neb. Rev. Stat. § 43-292(2), (6), and (7). Following a hearing on the State’s motion, the juvenile court terminated Maria’s parental rights to three of her four children pursuant to § 43-292(2), (6), and (7).

Assignments of Error on Appeal: On appeal, Appellant assigns that the juvenile court erred in finding that there was proof of clear and convincing evidence (1) that reasonable efforts were made to reunify the family, (2) that the minor children were within the statutory meaning of § 43-292 (2),(6), and (7), and (3) that it was in the best interests of the minor children to terminate her parental rights.
