A-25-0309 Charles L. Jeffers (Appellee) v. Lynne R. Jeffers (Appellant)
Hayes County, District Court, Judge Patrick Heng
Attorneys for Appellant: Bradley Holbrook, Samantha J. Merrill (Jacobsen, Orr, Lindstrom, & Holbrock, P.C., L.L.O.)
Attorney for Appellee: Jack W. Besse (Parker, Grossart & Bahensky, L.L.P.)
Civil Action: Marital Dissolution
Action Taken by Trial Court: The district court dissolved the parties’ marriage and distributed the marital estate.
Assignments of Error on Appeal: Appellant assigns that the district court erred in (1) failing to award Appellant alimony in gross despite Appellee’s health concerns making it the most equitable option given Appellant’s limited ability to improve her earning capacity and need to work as she establishes herself in a new state; (2) finding that, despite Appellee putting on no evidence as to the effect of intensive renovations to company housing, the purchase of additional farming equipment during the marriage, and the child care provided by Appellant during a major operational shift in the company, Appellee carried his burden of proof to show the appreciation of Jeffers Farms was not due to the active efforts of either party; and (3) holding that the additional eleven percent of Jeffers Farms acquired during the marriage was not marital property.
